1. Introduction and Acceptance

These Terms and Conditions (hereinafter, the "Terms") govern access to and use of the EPA Bienestar IA platform (hereinafter, the "Platform"), accessible through the domain info.epa-bienestar.com.ar and its associated subdomains.

EPA Bienestar IA is a women's cardiovascular health platform focused on evidence-based prevention, operating in collaboration with the Argentine Cardiological Foundation (FCA) and the Argentine Society of Cardiology (SAC).

By accessing and using the Platform, you declare that you have read, understood and accept these Terms in their entirety. If you do not agree with any of the conditions set out herein, we ask that you do not use the Platform.

2. Definitions

For the purposes of these Terms, the following definitions apply:

"Platform": The website info.epa-bienestar.com.ar and all its subdomains, including seguimiento.epa-bienestar.com.ar, mujer.epa-bienestar.com.ar and blog.epa-bienestar.com.ar.

"User": Any person who accesses, browses or uses the Platform's services.

"Services": The cardiovascular assessment tools, health calculators, screening forms, report generation, appointment scheduling, educational content and all functionality available on the Platform.

"LE8 Score": The cardiovascular risk score calculated according to the Life's Essential 8 framework of the American Heart Association (AHA).

"Medical Team": The cardiologist professionals and specialists who supervise and participate in the Platform's clinical services.

3. Description of Services

The Platform offers the following services aimed at cardiovascular prevention for women:

Cardiovascular Assessment

Cardiovascular health questionnaire based on Life's Essential 8 (AHA) with automatic LE8 Score generation and traffic light risk classification.

LE8 Calculators

Calculation tools for cardiovascular health indicators, including BMI, metabolic risk and other clinical parameters.

Personalized Plans

Personalized content and follow-up for four groups: Young women (18-30), Maternity Planning (28-48), Menopause (45-65) and 65+ Active.

Medical Referrals

Traffic light triage system (low, moderate, high risk) with referral to cardiologist specialists according to the identified risk level.

Educational Content

Articles, guides and resources on cardiovascular prevention, warning symptoms and healthy habits for women.

Appointment Scheduling

Scheduling system for medical appointments with cardiologist specialists, integrated with calendar and payment platforms.

4. Important Medical Notice

CRITICAL NOTICE

The Platform DOES NOT replace an in-person medical consultation. The information and results provided by the Platform are educational, guidance and preventive in nature. They do not constitute a medical diagnosis, nor do they replace an in-person consultation with a healthcare professional.

In case of medical emergency

Call 911 immediately or go to the nearest emergency room. The Platform does not provide urgent or emergency care.

The LE8 Score and generated reports are screening and guidance tools; they do not replace the clinical judgment of a medical professional.
The traffic light classification (low, moderate, high risk) is a reference to facilitate referral to specialists; the final assessment rests with the Medical Team.
Content generated by artificial intelligence is supervised by qualified medical professionals, but does not replace individualized clinical assessment.

5. Registration and Account

5.1. Age Requirements

The Services are intended for women over 18 years of age. By registering, the User declares and warrants that they are of legal age under applicable law.

5.2. Account Creation

To access certain Services, the User must create an account by providing true, complete and up-to-date information. Registration is done through mujer.epa-bienestar.com.ar.

5.3. Password Security

The User is responsible for maintaining the confidentiality of their login credentials (username and password) and for all activities performed on their account. In case of suspected unauthorized use, they must immediately notify hola@epa-bienestar.com.

6. Acceptable Use

The User agrees to use the Platform responsibly and in accordance with the law.

Permitted Uses

Conducting cardiovascular health assessments for personal use.

Accessing educational content on women's cardiovascular prevention.

Scheduling medical appointments with specialists through the Platform.

Using the health calculators for personal monitoring.

Prohibited Conduct

Providing false, misleading or inaccurate information in the health assessment forms.

Attempting to access restricted areas of the Platform, systems or networks without authorization.

Publishing, transmitting or distributing harmful, offensive, defamatory content or content that violates third-party rights.

Reproducing, copying, distributing or commercially exploiting Platform content without written authorization.

Using bots, scrapers or any automated system to extract data from the Platform.

7. Intellectual Property

All Platform content, including but not limited to texts, graphics, logos, icons, images, algorithms, software, designs, trade names ("EPA Bienestar IA", "Plan Bienestar 100 Días"), and the site structure, are protected by applicable intellectual and industrial property laws.

The Life's Essential 8 (LE8) framework is the property of the American Heart Association (AHA). Its use on the Platform is for educational and screening purposes in the field of cardiovascular prevention.

The User is granted a limited, non-exclusive, non-transferable and revocable license for personal use of Platform content. The User does not acquire any intellectual property rights over Platform content by accessing or using its Services.

8. Data Protection

The processing of personal and health data is governed by our Privacy Policy, which forms an integral part of these Terms.

HIPAA-aligned practices: The Platform adopts security and privacy practices aligned with international standards, including HIPAA (Health Insurance Portability and Accountability Act) principles for health information protection.

Health data: Data collected in cardiovascular assessments is stored under the HL7 FHIR R4 standard, ensuring portability and interoperability.

ARCO Rights: The User may exercise their rights of Access, Rectification, Cancellation and Opposition by writing to hola@epa-bienestar.com.

9. Limitation of Liability

To the maximum extent permitted by law, EPA Bienestar IA shall not be liable for:

Medical or health decisions made by the User based solely on the Platform's results.
Service interruptions, data loss or security failures caused by factors beyond our reasonable control.
The content, services or practices of third-party websites accessed from the Platform.
Direct, indirect, incidental or consequential damages arising from the use of or inability to use the Platform.

10. Modifications to Terms

EPA Bienestar IA reserves the right to modify these Terms at any time. Modifications will be effective upon publication on the Platform.

In case of substantial changes, registered Users will be notified by email and/or through a visible notice on the Platform with at least 15 (fifteen) days' advance notice.

Continued use of the Services after publication of modifications constitutes acceptance of the updated Terms. If you do not agree with the changes, the User must stop using the Platform and request account closure.

11. Termination

11.1. By the User

The User may stop using the Platform at any time and request account closure and deletion of their personal data by writing to hola@epa-bienestar.com.

11.2. By EPA Bienestar IA

We reserve the right to suspend or cancel any User's account that violates these Terms, without prior notice and without giving rise to any right to compensation.

11.3. Data Processing after Termination

After account closure, EPA Bienestar IA may retain anonymized data for statistical and research purposes. Identifiable personal data will be deleted within 30 (thirty) days, unless there is a legal obligation to retain it. Health data may be kept in accordance with applicable regulatory requirements.

12. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Argentine Republic, in particular:

Intellectual Property

The parties agree to submit to the jurisdiction of the Ordinary Courts of the Autonomous City of Buenos Aires.

13. General Provisions

13.1. Severability

If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions will remain in full force and effect.

13.2. Waiver

EPA Bienestar IA's failure to enforce any provision of these Terms shall not constitute a waiver of the right to do so subsequently. No waiver shall be valid unless formalized in writing.

13.3. Entire Agreement

These Terms, together with the Privacy Policy and other referenced legal documents, constitute the entire agreement between the User and EPA Bienestar IA regarding use of the Platform.
